Worse still, they are completely unregulated, with no way to determine what substances are in them that could potentially be hooking the younger generation. The situation is dire, but with the incoming administration, there’s a chance for a much-needed change.
The Gravity of the Situation
Florida, unfortunately, holds the record for the highest influx of these illegal products from China each year. The lack of FDA regulation makes it easy for these products to pass through Florida’s ports, with federal authorities practically helpless to prevent it. The scale of the issue is staggering – Florida faces an influx of $335 million worth of unregulated and illegal vape products from China yearly.
These vapes are not just a health risk but also a significant trade problem. Their enticing flavors specifically target young kids, and it’s impossible to determine what substances are used in these vapes – substances that could potentially be causing addiction in the younger generation.
Hope with the New Administration
But there’s a glimmer of hope with the new administration. The incoming Donald Trump administration has a golden opportunity to put a stop to this issue. The FDA, under President Joe Biden, had started a task force to combat this issue, but it resulted in little to no regulation. In fact, an opinion piece in the South Florida Sun-Sentinel highlighted the lack of a coherent strategy to deal with this crisis.
In a recent Senate hearing, it was revealed that the FDA has not been fully aiding or providing resources to state law enforcement, who have been struggling to manage the influx of illegal products from Chinese manufacturers. This is where the new administration can step in and make a difference.

The incoming Trump-Vance administration has a real chance to respond to this crisis effectively. If the new heads of the FDA and the Department of Homeland Security act swiftly and impose strong regulations, including port inspections, we can significantly reduce the flow of illegal products from China.
Retailers are ready to do right by their consumers, and organizations like the Florida Retail Federation (FRF) are prepared to collaborate with the new Congress and new leaders within the Trump-Vance administration to stamp out the flow of illegal vapes from China immediately.
